What you can do when your company tolerates sexual harassment

California employers have a duty to prevent sexual harassment in the workplace. However, some businesses ignore their responsibilities, leaving workers unprotected. 

Be aware that you do not have to tolerate a hostile work environment. If your company fails to act, you have options. 

Know your rights

California has strong workplace protections. The Fair Employment and Housing Act (FEHA) requires employers with five or more employees to prevent and address harassment. This includes having a written anti-harassment policy and training supervisors and employees. Companies must also have a clear process for reporting harassment that leads to a prompt and fair investigation of complaints.

If your company does not follow these rules, they are breaking the law. This opens the door for you to take legal action because you have the right to work in a safe environment, free from harassment and retaliation.

You can take action if your employer fails you

If your company ignores or mishandles harassment complaints, you can take these steps:

  1. Document everything: Write down details of each incident, including dates, times, locations, and witnesses. Save emails, messages, or any other evidence.
  2. Report the harassment: Follow your company’s reporting process. If they do not act, escalate the complaint to a higher manager or human resources.
  3. File a complaint with the California Civil Rights Department (CRD): If your employer does not take your complaint seriously, you can report the company to the CRD. They investigate workplace harassment claims and can take action against companies that break the law.
  4. Seek support: Talk to a trusted coworker, friend, or advocacy group. Organizations that focus on workers’ rights can provide guidance.

Employers have a duty to protect their workers from sexual harassment. When they fail, you do not have to stay silent. Knowing your rights and taking swift action can help create a safer workplace for yourself and others.
